Mundo Arjona® Terms and Conditions of Service These terms and conditions (hereinafter referred to as “Terms”) govern the use of the websites https://www.mundoarjona.com/, https://membresia.mundoarjona.com, Ricardo Arjona App (https://ricardoarjona.com/), Mundo Arjona Store (https://www.mundoarjona.com), and the Ricardo Arjona App on the App Store and Google Play (collectively, “Mundo Arjona”); by users (hereinafter referred to as “the user”, “Member”, “You” or “Your”) and their relationship with Be Smart Mobile LLC (operating as “Mundo Arjona®”) with address at 31 NE 17th St., Miami, Florida, USA. 1. Agreement: (Hereinafter referred to as “we”, “us” or “our”). Please read these Terms carefully, as they affect your rights and responsibilities under the law. If you do not agree with these Terms, please do not access or use the Website or any of the services offered under the Mundo Arjona® brand. Description of the Service Mundo Arjona now offers users a monthly membership for $7.99 USD with automatic renewal. This membership provides access to a digital platform that includes exclusive audiovisual content from artist Ricardo Arjona, as well as unique experiences and benefits for its members. When you subscribe to Mundo Arjona, you will receive a card with a unique code identifying you as an official member, granting access to various benefits, which include but are not limited to: Priority access to purchase tickets for unforgettable events Access to presale of unique experiences Enjoy the show as a VIP fan: access to the VIP Lounge with limited spots All of Mundo Arjona in one app: access to the complete discography of Ricardo Arjona and more Possibility of acquiring complimentary tickets, subject to availability Exclusive discounts on official merchandise You are eligible to experience something unique and many surprises Mundo Arjona also organizes exclusive events called “Experiences,” which take place on a limited and occasional basis, depending on the capacity and conditions of the venues where concerts are held. The management and organization of these experiences is handled by the Mundo Arjona operations team and will be subject to availability. Access to tickets for these events or any experience will depend on the availability of spots and other specific conditions, which will be detailed on our platform. EXPERIENCES AND BENEFITS 2.1. TERMS AND CONDITIONS: SPECIAL EVENT PRESALE Mundo Arjona® offers users with an active subscription the possibility of early access to the presale of special events, which may or may not include the presence of the artist Ricardo Arjona, and which may eventually be presented under alternative names. This does not imply any change in the concept or in the terms and conditions of the experience. The number of tickets available during the presale may vary depending on the event, city, venue, and the specific provisions of each production. The conditions for accessing each pre-sale may vary and will be subject to internal definitions established by the Mundo Arjona® team. This includes, but is not limited to, requirements related to the user’s subscription status, tenure, continuity, or type, as well as the application of restrictions on the frequency or number of accesses to pre-sales within a given period. Such conditions will be determined and communicated in advance for each pre-sale, and compliance with them will be essential to participate. These measures are intended to ensure equitable access for all community members, preventing a single user from repeatedly concentrating pre-sale opportunities and promoting broader enjoyment of the offered benefits among a larger number of subscribers. Users interested in accessing the presale must reserve their spot through the website: https://experiencias.mundoarjona.com Participation will be strictly limited to active members of Mundo Arjona® who meet the established criteria for each case, and access to tickets will be subject to availability. In the event that general ticket sales are enabled for any of these special events, the exclusive presale for members will be announced via email, Mundo Arjona®’s official social media, and/or through the membership card with a unique code. The ticket may carry an additional cost beyond the subscription fee and will be determined by the organizer. The purchase will be considered confirmed only when the payment has been credited to the organizer's account. The organizer may apply Service Fees if deemed necessary. Ticket purchases cannot be canceled or refunded. Mundo Arjona®, the artist, or the production are not responsible for transportation or for any incidents that may arise during the event. The user agrees to these terms and conditions upon completing the purchase of the ticket acquired during the presale. 2.2. TERMS AND CONDITIONS: MUNDO ARJONA® COMPLIMENTARY TICKETS Mundo Arjona® offers users with an active subscription the opportunity to request a complimentary ticket to attend a show by the artist through the website experiencias.mundoarjona.com. Each show has a limited stock of complimentary tickets; once this stock is depleted, the experience will be marked as Sold Out. In that case, the user will have the option to purchase a ticket through the event's other official sales channels. Users with a Mundo Arjona® membership may obtain up to one (1) ticket per valid membership period (referred to as the “complimentary ticket”), under the following method: one ticket per redemption. 2.1. The user must visit the website experiencias.mundoarjona.com to redeem their complimentary ticket. This redemption does not constitute the official admission ticket to the show but serves as proof that a spot has been successfully secured. The available dates and times for redeeming the ticket will be communicated through our user contact channels (email, websites, and social media). 2.2. The user must select the show in the city and on the date of their choice and request access through the website. 2.3. The system will validate the user’s subscription status to approve or deny the request. 2.4. If all conditions are met, the redemption will be approved, and the user will be notified via the email address associated with their Mundo Arjona® subscription. 2.5. After the redemption process is completed, the delivery process for the official admission ticket will begin. The complimentary ticket will be sent either to the email address used for the subscription or directly by the official ticketing platform of the event venue. Each complimentary ticket may be delivered through either of these two methods, depending on the city, the venue, and the overall organization of the event. 3. Mundo Arjona® obtains the complimentary tickets for each show through the official producers and ticketing platforms of the venues where the artist Ricardo Arjona performs. Therefore, once the Mundo Arjona team receives or is granted access to the official admission tickets for the show, they will be immediately sent through any of the aforementioned channels to the members who have successfully redeemed their complimentary tickets. The user understands and accepts that the delivery timeline for the complimentary ticket is subject to this clause. 4. Complimentary tickets are subject to limited availability. Users who complete the redemption process correctly on the website experiencias.mundoarjona.com (as long as tickets are still available) will be eligible for the benefit. It is important to note that if a user has already redeemed one (1) experience during their current membership period, the system will not allow another redemption under the same user for that same membership period. This mechanism is intended to ensure that all members of Mundo Arjona® have a fair opportunity to access the available benefits, including complimentary tickets and experiences offered during the subscription period. 5. Mundo Arjona®, the artist, or the event production are not responsible for transportation of the beneficiaries to the concert venue. 6. Mundo Arjona® and/or the artist are not responsible for any incidents or events that may occur at the venue on the date of the concert. 7. Complimentary tickets may be made available for shows on Ricardo Arjona’s tour; however, they are subject to availability. Mundo Arjona® does not guarantee that complimentary tickets will be available for all cities or tour dates, and access will depend on ticket availability for each specific event. 2.3. TERMS AND CONDITIONS: VIP LOUNGE Mundo Arjona® offers subscribers with an active membership the opportunity to participate in a VIP Lounge experience in their city. This experience consists of access to a hospitality area before the show, where fans can enjoy an exclusive moment. Participation in this experience may have an additional cost beyond the subscription, which will be determined based on the event, city, and its organization. Subscribers may reserve their spot for this experience through the website experiencias.mundoarjona.com The number of participants allowed in this experience will depend on the venue's capacity, the city, the show date, the experiences enabled by the venue, as well as decisions made by the Mundo Arjona® team. In the event that the VIP Lounge experience is canceled or rescheduled due to reasons beyond the control of Mundo Arjona® and/or the event's production team, every effort will be made to notify subscribers as far in advance as possible. Participants in the VIP Lounge experience may not request cancellations or refunds for this purchase. It is important to note that the experience DOES NOT INCLUDE access to the concert. Subscribers selected for this experience must already have their concert ticket, which must be purchased separately. Mundo Arjona®, the artist, or the event production team are not responsible for the transportation of participants to the venue, nor for any incidents that may occur at the venue on the day of the show or during the activities related to the experience. The user agrees to these terms and conditions upon submitting the reservation form for the experience. 2.4. TERMS AND CONDITIONS: SOUND CHECK Mundo Arjona® offers active members the opportunity to participate in the “Sound Check” experience. During this activity, Mundo Arjona® members may attend the artist’s sound check prior to the selected show. This type of experience will be held occasionally and will not be available in all cities. If it does take place, members will be notified in advance. Users may reserve their spot through the website: experiencias.mundoarjona.com The event will have limited capacity, in accordance with the regulations of the venue where it is held. The invitation to the event does not include access to the concert. If the user wishes to attend the concert, they must purchase a ticket through any of the official sales channels. The experience is available to members only and may carry an additional cost depending on the agreements made with the venue and the format of the event. These conditions may vary according to the city, venue, and overall organization. Only one (1) spot may be reserved per user with a verified active membership. The organizer may charge a Service Fee if deemed necessary. Mundo Arjona®, the artist, or the event production team are not responsible for the transportation of participants to the venue. Mundo Arjona® and/or the artist are not responsible for any incidents or events that may occur at the venue on the event date. The user agrees to these terms and conditions upon submitting their reservation request. 2.5. TERMS AND CONDITIONS: ENCUENTROS Mundo Arjona® offers subscribers the opportunity to participate in themed events called “Encuentros.” These are gatherings of fans who are active members of Mundo Arjona®, where they come together to share experiences, anecdotes, and activities inspired by the artist Ricardo Arjona. “Encuentros” may take place with or without the presence of the artist or musicians. Users may reserve their spot through the website: experiencias.mundoarjona.com Only one (1) spot may be reserved per user with a verified active membership. Once the member redemption quota has been filled, the organization may open ticket sales to non-members interested in attending. Each person may purchase up to four (4) tickets per order, provided the total number of spots for the event is not exceeded. Payment methods and ticket pricing will be determined by Mundo Arjona® and the event organizers. Ticket purchasers WILL NOT be able to request cancellations or refunds. Invitations to the event, whether through membership redemption or ticket purchase, may or may not include food, drinks, or refreshments. This will depend on the agreement with the venue and the internal organization of the Mundo Arjona® team. The event will have limited capacity, in accordance with the regulations of the venue where it is held. The experience is available to all members. Redemption of the experience DOES NOT INCLUDE access to the concert. The purchase of a ticket to “Encuentros” does not include access to any concerts. Attendees must present proof and/or confirmation of their ticket purchase upon arrival to gain entry. Mundo Arjona®, the artist, or the event production team are not responsible for the transportation of participants to the event venue. Mundo Arjona® and/or the artist are not responsible for any incidents or events that may occur at the venue on the event date. The user agrees to these terms and conditions upon submitting their reservation request. 2.6. TERMS AND CONDITIONS: MUNDO ARJONA® STAFF EXPERIENCE Mundo Arjona® offers active members the opportunity to participate in the “Mundo Arjona® Staff Experience.” This experience allows fans to be involved in the organization and logistical support process of the artist’s shows, working alongside the actual Mundo Arjona team staff. Interested users must apply to participate in this experience by completing the application form available on the website experiencias.mundoarjona.com The number of participants in the experience will be determined based on the city, show date, experiences authorized by the venue, and decisions made by the Mundo Arjona® team. The system will validate the user’s subscription status in order to approve or deny the application. As many winners as needed for each concert will be selected, along with one or two alternates, according to established criteria. Participation in this experience DOES NOT INCLUDE access to the concert. Participants must already have access to the show through other means. Mundo Arjona®, the artist, or the event production team are not responsible for the transportation of participants to the concert venue. Mundo Arjona® and/or the artist are not responsible for any incidents or events that may occur at the venue on the concert date or while fulfilling the assigned tasks. The user agrees to these terms and conditions upon submitting the application form for the experience. 2.7. TERMS AND CONDITIONS: BACKSTAGE TOUR Mundo Arjona® offers users with an active subscription the opportunity to participate in the Backstage Tour held in the selected city. This experience consists of giving fans a behind-the-scenes tour of the show, including work areas, technical equipment, and/or production meetings. The execution of this experience is subject to its practical feasibility at each location. Users may reserve their spot through the website experiencias.mundoarjona.com. The number of participants will be determined based on the city, show date, experiences authorized by the venue, and decisions made by the Mundo Arjona® team. The experience DOES NOT INCLUDE access to the concert. Those selected for the experience must already have access to the show through other means. It is also possible that after the experience concludes, participants may be required to exit the venue and re-enter with the general public, depending on the security policies of each venue. Mundo Arjona®, the artist, or the event production team are not responsible for the transportation of participants to the concert venue. Mundo Arjona®, the production team, the venue, and/or the artist are not responsible for any incidents or events that may occur at the venue on the concert date or during the experience. The user agrees to these terms and conditions upon submitting the application form for the experience. If the user arrives later than the indicated time, unfortunately the experience cannot be rescheduled, as it is a one-time activity held at a specific time and day prior to the show. 2.8. TERMS AND CONDITIONS: OFFICIAL MUNDO ARJONA® MERCH Mundo Arjona® may offer Official Merch from the exclusive Mundo Arjona brand, which will be available for purchase by members of the fan community. If this Official Merch is launched, Mundo Arjona® may offer special discounts or provide gifts to members with an active card, as an exclusive benefit for being part of the artist’s fan community. These discounts and/or gifts will be applied according to the specific terms of each promotion and will be communicated through Mundo Arjona®’s official channels. The availability and sale of merchandise at the artist’s shows may vary and will depend on each city and/or country where the events are held. Additionally, the Official Merch may also be sold through the official Mundo Arjona® store, whose availability and shipping will be subject to the logistical conditions of each city and/or country. 3. Subscription and Automatic Renewal These terms and conditions establish the subscription policies applicable to any user who acquires a membership, product, or service through any of our platforms (Website, Ricardo Arjona App, or Mundo Arjona Store). Your membership subscription, which you access through the Website, Ricardo Arjona App, or Mundo Arjona Store, includes enrollment in a payment plan. Your subscription will automatically renew at the end of each billing period, unless you cancel it in accordance with the cancellation instructions provided below, without penalties or additional early termination fees. Payment will be charged to the payment method you selected when confirming your subscription, and at the beginning of each new billing cycle, unless canceled in due time. The billing period corresponds to the interval between each recurring billing date, depending on the duration of your subscription. Acceptance By creating an account, watching videos, making a purchase, downloading branded applications, posting on the fan chat wall in the Ricardo Arjona App, or through any other interaction, visit, or use of any Mundo Arjona® Service, the user agrees to this Agreement and consents to contract with us electronically. We reserve the right to update these Terms at any time. Any modifications will be duly communicated via an announcement on the Website and other communication channels. It is your responsibility to check for such updates. These modifications will apply to the use of the Website, Ricardo Arjona App, and Mundo Arjona Store once the announcement has been made. If you do not accept the new Terms, you must stop using our services. By continuing to use any of our services after the date the modification comes into effect, you indicate your agreement to be bound by the new Terms. You also confirm and accept that we will not be held responsible for modifications or the temporary or permanent removal of any content you post via the fan interaction channels on our digital platforms developed under the Mundo Arjona® brand. You may terminate this Agreement at any time by deleting your account via our support channel: contacto@mundoarjona.com. We reserve the right to suspend or cancel your account if you breach the terms of this Agreement. If Mundo Arjona deletes your account due to a violation, you may not register again. ANY PERSON WHO DOES NOT ACCEPT THESE GENERAL TERMS AND CONDITIONS, WHICH ARE MANDATORY AND BINDING, MUST REFRAIN FROM USING THE MUNDO ARJONA WEBSITE, RICARDO ARJONA APP, MUNDO ARJONA STORE, AND ANY OTHER PRODUCT DEVELOPED AND OFFERED BY MUNDO ARJONA. 5. Subscription Modification, Cancellation, and Refund Policy You can update or review your personal registration information at any time from your account settings once you’ve logged in. You may cancel your subscription at any time before the current billing period ends. Cancellation must be made at least 24 hours before renewal to avoid being charged for the next cycle. You can cancel your subscription by logging into your Mundo Arjona account at https://membresia.mundoarjona.com/account and clicking the "Cancel" button, or by contacting our support team at contacto@mundoarjona.com. The cancellation will take effect at the end of your current billing period, and you will continue to have access to the service until that time. We do not provide refunds or credits for unused billing periods. Charges for services already provided by Mundo Arjona will not be refunded under any circumstances, including in cases of suspension, cancellation, or rescheduling of an event. 6. Contribution to Fundación Adentro By purchasing a Mundo Arjona® membership, fans are supporting Fundación Adentro, a nonprofit organization created by the artist Ricardo Arjona. Fundación Adentro works to improve education and provide opportunities for children and youth in underserved communities, promoting a holistic learning environment and the development of educational projects. By being part of Mundo Arjona®, fans contribute to the mission of the foundation, helping to make a difference in the lives of those who need it most. 7. Registration You represent and warrant that all personal information provided during registration is true, accurate, current, and complete in all respects; and that you are not impersonating any other person or entity. Products or services purchased on any of Mundo Arjona®'s platforms are for private and personal use only and not for resale. You agree to notify us immediately of any changes to your personal information by sending a message to contacto@mundoarjona.com. 8. Privacy Policy We will treat all your information as confidential and use it only in accordance with our Privacy Policy (https://membresia.mundoarjona.com/privacy). When you make a purchase on our Website, Ricardo Arjona App, or Mundo Arjona Store, we will request personal information to identify you, such as your name, email address, billing address, shipping address, credit card or other payment details. We confirm that we will store this information in accordance with our registration with the Data Protection Commissioner. Protecting Your Security To ensure that your credit, debit, or charge card is not being used without your consent, we will validate your name, address, and other personal information provided during the order process by verifying it against third-party databases. We take Internet fraud very seriously. Due to the high volume of credit card fraud, we take all necessary steps to ensure all orders are thoroughly reviewed using the information provided. We may contact you for additional security checks and kindly request your cooperation in completing these verifications. We do not tolerate fraudulent transactions, and such activity will be reported to the relevant authorities. By accepting these Terms and Conditions, you authorize us to carry out such verifications. During these verifications, personal information you provide may be disclosed to a credit reference agency, which may keep a record of that information. This is done solely to confirm your identity; a credit check is not performed, and your credit rating is not affected. All information you provide will be handled securely and strictly in accordance with the Data Protection Act 1998. 10. Compliance The Mundo Arjona Website, Ricardo Arjona App, and Mundo Arjona Store may only be used for lawful purposes and in a lawful manner. You agree to comply with all applicable laws, rules, and regulations related to the use of Mundo Arjona® and its services. You agree not to introduce or transmit through any of the aforementioned platforms any computer virus or any other element intended to interfere with, interrupt, or disrupt the normal operating procedures of a computer; nor any material that is defamatory, offensive, or obscene in nature. 11. Third-Party Links As a convenience to our customers, the Website, App, and Store may include links to other websites or materials that are outside of our control. Please note that we are not responsible for such websites or materials and do not review or approve them. We shall not be liable, either directly or indirectly, for the privacy practices or content of such websites, nor for any damage, loss, or breach caused or allegedly caused in connection with the use of or reliance on any advertising, content, products, materials, or services available on such external websites or resources. 12. Purchases All purchases are subject to acceptance and availability. If the requested goods are not in stock, a similar item with equivalent characteristics will be provided. Any online order you place will be treated as an offer to purchase our tangible or intangible goods. We reserve the right to reject any of your offers at any time. As a user, you agree that any automatic order confirmation you receive from us does not constitute our acceptance of your offer to purchase products or services from our site. A contract between you as the user and us will only be formed when: (i) we charge your debit or credit card or other authorized payment method, or (ii) we dispatch the tangible or intangible goods purchased. We will make every effort to keep your order and payment details secure. However, unless negligence on our part is proven, we cannot be held responsible for any loss you may suffer if a third party gains unauthorized access to any data you provide while accessing or placing an order on the Website, App, or Store. Goods or services purchased on any Mundo Arjona® platform are not intended for resale or redistribution. You are limited to purchasing a maximum of 10 units of the same item. We reserve the right to cancel orders and/or suspend user accounts if we believe that purchased items violate this clause or are no longer available. You are responsible for the goods once they have been delivered to the email address you provided at the time of purchase. We are not liable if you provided an incorrect email address. If you entered an incorrect email and wish to correct it, please contact us at contacto@mundoarjona.com. 13. Delivery The delivery of purchases made through any of the Mundo Arjona platforms (Website, App, Store) will be governed according to the purchase details at the time of the transaction and based on the specific product or service obtained. For tangible goods: Merchandising products will be available for pickup at our stand, in the city selected by the buyer. For tickets or event passes: These will be delivered via email, either through ticketing platforms or as attachments sent directly by email. 14. Right to Cancel a Purchase Once the purchase of tickets or experiences is accepted and payment is made, no refund or return can be requested. The user may only request cancellation and a refund of the cost if the event is permanently canceled (with no rescheduling) by the producer and/or event organizer. If the date of an event is changed for any reason, the ticket or experience reservation will remain valid for the new date as determined and communicated by the organizer. The rescheduling of an event will in no case entitle the user to request a refund of the purchase. Service charges for services effectively provided by Mundo Arjona® will not be refunded under any circumstances. 15. Price and Payment All prices displayed on the Website, Ricardo Arjona App, and Mundo Arjona Store are in U.S. Dollars (USD) and are correct at the time they are entered into the system. However, we reserve the right to change prices at any time without prior notice (please note that these changes will not affect orders for which you have already received a Shipping Confirmation). Payment may be made by any major international credit or debit card. If your card payment is unsuccessful for any reason, we reserve the right to retry the transaction within 48 hours. If you do not want us to retry the payment, you must cancel your order in advance. You confirm that the credit or debit card used belongs to you. All credit and debit cardholders are subject to validation checks and authorization by the card issuer. If your payment is refused or not authorized for any reason, we will not be liable for any delay or failure to deliver your order. If discount codes are enabled, they will be governed strictly by the terms and conditions under which they were created, which may include your eligibility to use them and a maximum order value. Please review those terms before placing your order, as we reserve the right to reject or cancel any order that does not comply with them, even if your card has already been charged. If there is any inconsistency between the discount code terms and these Terms and Conditions, the discount code terms will prevail. Eligibility to Purchase To lawfully purchase tangible or intangible goods from the Website, Ricardo Arjona App, or Mundo Arjona Store and enter into binding contracts, you must: If an individual, be at least 18 years old; and Register your real name, address, phone number, email address, and any other required details. By offering to purchase goods or services, you confirm that you are a legal adult and authorize us to transmit information (including updated information) to third parties, including but not limited to your credit or debit card numbers or credit reports, to authenticate your identity, validate your card, obtain initial credit authorization, and authorize individual purchase transactions. 17. Intellectual and Industrial Property The content of Mundo Arjona® is protected by copyright, trademarks, databases, and other intellectual and industrial property rights. You acknowledge that the material contained in and provided through the Website, Ricardo Arjona App, and Mundo Arjona Store is owned by us or our licensors. Where appropriate and determined by the Mundo Arjona® organization, we will cancel the accounts of individuals who infringe upon these policies. 18. Limitations of Liability We exclude any liability in relation to the following: Incompatibility of the Website with any of your equipment, software, or telecommunications connections; Technical problems, including errors or interruptions on the Website; Unsuitability, unreliability, or inaccuracy of the Website in meeting your purchasing requirements. To the fullest extent permitted by applicable law, you agree that we shall not be liable to you or any third party for any consequential or incidental damages (including, without limitation, loss of income, loss of business, loss of anticipated savings, wasted expenses, loss of privacy, or loss of data), or any indirect, special, or punitive damages arising from or related to any of the Mundo Arjona® platforms. 19. Prohibited Technical Actions You agree not to do the following, unless permitted by law or expressly authorized by us: Extract, reproduce, distribute, create derivative works from, decompile, reverse engineer, modify, archive, or disassemble any part of the Mundo Arjona® Service or of Be Smart Mobile LLC; Attempt to circumvent any of our security measures, rate limits, filtering, or digital rights management systems; Send any malicious program, script, or code; Send an unreasonable number of requests to our servers; Take any other action to manipulate, interfere with, or damage the Mundo Arjona® or Be Smart Mobile LLC services. 20. Arbitration Agreement These Terms and Conditions establish a binding arbitration agreement between you and Be Smart (the "Arbitration Agreement"). Under this Arbitration Agreement, you agree to: Arbitrate all claims related to the Be Smart Service; Waive your right to a jury trial; and Waive any right to proceed on a class basis in arbitration or otherwise. The exclusive means of resolving any dispute or claim arising out of or related to this Agreement (including any alleged breach thereof), or your use of Be Smart Mobile LLC (Mundo Arjona), shall be BINDING ARBITRATION administered by JAMS, in accordance with its Streamlined Arbitration Rules and Procedures, as modified by our Arbitration Procedures. Arbitration provides a private dispute resolution process that is typically faster and less formal than litigation.
